Child Support in New York

Any couple that goes through a divorce has to deal with many issues, but those that have children usually go through even more acrimony when dealing with custody and support for their children. Child support is financial support provided by the noncustodial parent. Child support includes, cash payments (based on the parent’s income and the needs of the child), health insurance for the child, payments for child care, and payments for reasonable health care costs that are not covered by health insurance. Family Court determines the amount of child support the noncustodial parent will pay. Under New York State law, parents are responsible for supporting their child until the child is 21 years old.

There are guidelines in which the court uses to determine the amount of child support that is owed to the custodial parent, based on the noncustodial parent’s adjusted gross income and on the number of children involved. The court first determines the noncustodial parent’s gross income. The court then multiplies the adjusted gross income by the standard guideline percentage for the number of children. These percentages are as follows:
17% for one child
25% for two children
29% for three children
31% for four children
at least 35% for five or more children.
Then the noncustodial parent’s share of child care, medical, and educational expenses is added to the income percentage amount. The combined amount, percentage of income plus share of expenses, is the basic child support amount.

For incomes over $130,000, the court determines whether or not to use the percentage guidelines and may consider other factors in setting the full child support payment.

The main problem that many noncustodial parents have an issue with is that many fill out long and tedious expense forms and when it comes time to determine the monthly the courts do not take into consideration the expenses of the noncustodial parent. If you cannot pay your child support you can file a “petition for modification” with the court that issued the support order. Only the court can change what you owe. Just because you think you cannot pay, do not stop paying. Continue to pay what you can while you wait for the court to make a decision. You should know that the court will only change the amount of support you need to pay if there has been a substantial change in your ability to pay.

However, the process is not quite over yet. There is one more decision to be made: whether to reveal the name to the others or to keep it a secret till the baby finally arrives. There is no right or wrong way. Some couples think it is okay for them to share the baby name and get the input of the rest of the family and friends, others prefer not to share their pick at all.

In most cases grandparents and immediate family appreciate being kept in the loop. Nurture An Extra Mother This Year

The day we honor the role of mothers is typically reserved to our own mothers and grandmothers, for those who are still fortunate enough to have them. I recommend that we celebrate Mothers Day (or some day) a bit more broadly. Here are a few examples of the kinds of women I have in mind, although I am certain you can add to my list.

The woman in the neighborhood who has never had a child of her own makes a motherly contribution each Halloween when she pretends to be afraid of a scary costume, in awe of the fairy princess and bemused by the boy who arrives in his jeans and t-shirt hoping for some of her delicious popcorn balls.

The stay at home mother who does more than her share of the car pooling duties for your own kids, and frequently takes a wholesome fruit snack to the kindergarten class.

Your daughter who has become such a wonderful mother in her own right.

The local librarian who reads so enthusiastically to all the children at story hour each Saturday morning.

The checkout woman at your local supermarket who offers all the children a candy cane from her smock pocket each holiday season (even though you would prefer that she offer fruit).

The sad woman who lost a child this year, whether that child was a toddler or a retired fire fighter.

The other sad woman down the street whose dear mother is absent for the first Mothers Day in the daughter’s life.

The enthused but exhausted woman in the next block who gave birth to twins or one child who just seems like twins.

This year, whether you are male or female, parent or not, recognize one or two or three of these women. They may not be central to your life, but they still make a contribution to it.

Send them a hand written note thanking them, invite them to your home for Mothers Day dinner, deliver a single rose or a huge bouquet. Most importantly, just thank them.

As an avid shopper for each and every holiday or festive occasion celebrated in America, Im a firm believer that all retail stores and websites save the best until last, (the last moment). My purchasing pattern follows that of most Americans, I buy gifts at the very last minute. It doesnt matter what the holiday is, how great a mad rush to the shopping mall there will be or how long I have to wait in line get to a shelf or a cash register, I firmly believe that last minute shopping is the way to go if you want to buy something good. Here are a few guidelines to help you shop for your mothers day gift baskets.

The Time Span

The last minute to shop for mothers day gifts begins when theres about two weeks left until the holiday, so roughly your mothers day shopping should begin at the latest by the start of May. If you think that you can wait another week, I can tell you its out of the question and if youve shopped in the time span of one week for mothers day gift than youre more of a forgetful child than an accomplished shopper.

The Gift

The gift to buy will already have appeared before you, itll be whats selling the hottest and most likely to go out of stock in the coming week. I found one of the best mothers day gifts in the first week of May. I had planned on buying mothers day fruit baskets for my mom and my grandma and I was just waiting for the really good stuff to come out which it did in that first week of May. There was a real rush at a store for fruit bouquets, (Id never even heard of them before that) but one look at them and I knew they were just what I wanted! They were made entirely of fruit, different kinds of fruit like strawberries, pineapples, bananas, oranges and apples. They even had chocolate dipped strawberries and dipped pineapples shaped like daisies and hearts. There were special mothers day arrangements available and I ordered some for my mom and grandma (the store had a site to place the orders anywhere in the U.S.).

The Surprise

Apart from getting a gift for my mom, I always visit her. This doesnt have anything to do with shopping but I get to see my mom and if the gift isnt what she expected (this rarely happens) my being there makes up for it and I get to see he reaction when she gets her gift.
